This Portal: https://www.fieldtrack360.com/ (includes its pages, extensions etc., but not limited to) and other as may be launched from time to time (hereinafter referred to as “Website”, “Product ” and/or “Application”, “Platform” which shall mean and be used interchangeably having the same meaning) is a SaaS-based field workforce management platform that enables companies and organizations to onboard, manage, monitor, and track their field employees through mobile-enabled GPS tracking, attendance management, task coordination, and reporting tools. The Platform is developed, operated and maintained by Devstree IT Services Private Limited (“The Company”), a company, having its office at B – 220, Money Plant High Street, Near Ganesh Glory, Jagatpur Road, S.G. Highway, Ahmedabad – 382470, Gujarat, India.

In the Privacy Policy, “we”, “our” and “us” means the Company and “Business User” or “Client” or “Admin” means any organization, or enterprise that subscribes to and administers the Platform; “End User” or “Field Employee” means any individual employed or engaged by a Business User who accesses the Platform via the mobile application; “you” and “your” means any person who accesses and uses this Product, including both Business Users and End Users. This Privacy Policy covers the Product’s treatment of personally identifiable information that the company collects when you are on this platform and afterwards, and when you use this Platform’s services. This policy also covers the company’s treatment of any personally identifiable information (“PII”) that users share and/or the PII which the company may fetch/collect from various service providers with whom the company has integrated its systems to provide the necessary services to you. This policy does not apply to the practices of companies that the company does not own or control or to people that the company does not employ or manage.

This policy should be read together with our terms & condition. If you use any of our Services, you will be regarded as having read and accepted this Policy. You must not use this Product or our Services if you do not accept this Policy. By mere use of this Product, you expressly consent to our use and disclosure of your personal information in accordance with this Policy.

Our privacy policy is subject to change at any time without notice. To make sure you are aware of any changes, please review this policy periodically. Continued use of the Platform after any such modification constitutes your acceptance of the revised Privacy Policy. Your consent to use the cookies in accordance with the terms of this policy when you first visit our website permits us to use cookies every time you visit our website. Further, your consent shall enable our browser extension feature to enable us to store your last visits, conduct data analytics etc.

This Privacy Policy covers this Product’s treatment of personally identifiable information that the company collects when you are on this Product and afterwards, and when you use this Product’s services. This policy also covers the company’s treatment of any personally identifiable information (“PII”) that users share and/or the PII which the company may fetch/collect from various service providers with whom the company has integrated its systems to provide the necessary services to you. This Privacy Policy has been updated to comply with the provisions of the Digital Personal Data Protection (DPDP) Act, 2023, ensuring transparency, data security, and protection of individual rights. We have taken measures to align with the DPDP Act’s principles, including data minimization, purpose limitation, and consent management. Additionally, this Policy specifically addresses the collection and processing of precise location data, attendance data, and field workforce monitoring data in compliance with applicable Indian laws.

COLLECTION OF AND PROCESSING OF YOUR PERSONAL DATA

The use of the Product may result in the collection and processing of your personal data. For the purposes of applicable data protection laws, “personal data” means any information relating to an identified or identifiable natural person, including personally identifiable information (PII). This includes, but is not limited to, your name, contact details, identification information, and technical data such as your IP address, which may be considered personal data.

In the course of providing services through the Product, we may also collect and process employment-related data, GPS location data, real-time attendance records, task and activity logs, route histories, and device and usage data. Such location and workforce monitoring data is treated with a higher standard of care and confidentiality in accordance with applicable laws.

When you use the Product, we collect personal data that you voluntarily provide, including information submitted through onboarding, registration, employee profile creation, attendance check-ins, task updates, expense submissions, or communications. In addition, we automatically collect certain technical and usage-related information when you interact with the Platform, such as device information, GPS coordinates, background location data (during configured working hours) browser type, IP address, session data, and usage patterns, for purposes including service improvement, analytics, and security.

We process personal data in compliance with applicable data protection laws and regulations. We will only process such data where we are legally permitted to do so, including on the basis of: (i) your explicit consent, particularly in the case of sensitive personal data such as precise location data and employment information, (ii) the performance of a contract to which you are a party or to take steps at your request prior to entering into a contract, (iii) compliance with legal or regulatory obligations, and/or (iv) our legitimate interests or those of a third party, provided that such interests are not overridden by your fundamental rights and freedoms.

We implement appropriate technical and organizational measures to ensure the security, confidentiality, and integrity of personal data and sensitive personal data, including protection against unauthorized access, disclosure, alteration, or destruction. Location data, attendance records, and employee activity data are accessed only on a need-to-know basis, subject to role-based access controls, and processed strictly for the purposes for which they were collected. Depending on the nature of services, the Company may act as a Data Fiduciary under applicable data protection laws. Business Users (companies/admins) who access and process their employees’ data on the Platform may act as independent Data Fiduciaries.

COLLECTING PERSONAL INFORMATION

We may collect and process the following categories of personal data and sensitive personal data, including but not limited to:

Information Collected from Business Users (Companies / Admins)

  1. Company and organization identity information, including registered company name, company address, GST/PAN/TAN number, industry type, and company size;
  2. Administrator account information, including admin name, designation, email address, mobile number, and login credentials;
  3. Subscription, billing, and payment-related information including invoicing details, payment instrument data, and transaction records processed through secure payment mechanisms;
  4. Configuration and settings data, including workforce hierarchy structures, branch details, geofencing parameters, attendance policies, shift configurations, and task templates;
  5. Communications and support-related information shared with the Company for onboarding, integration, or technical assistance purposes;
  6. Information about your device and system, including IP address, geographical location, browser type and version, and operating system, collected when accessing the web dashboard.

Information Collected from End Users (Field Employees)

  1. Identity and contact data, including full name, employee ID, designation, department, mobile number, and email address, as provided or configured by the Business User during onboarding;
  2. Precise GPS location data, including real-time geographical coordinates, location timestamps, geofencing check-in/check-out records, movement trails, and route history, collected via the mobile application during configured working hours;
  3. Background location data: Where enabled by the Business User and consented to by the Field Employee, the mobile application may collect location data in the background while the application is running during working hours, for the purpose of continuous route tracking, attendance verification, and productivity monitoring;
  4. Attendance and work-hour data, including punch-in and punch-out timestamps, GPS-verified attendance records, total working hours, overtime records, and payroll-ready attendance reports;
  5. Task and activity data, including assigned tasks, task completion status, visit logs, client interaction records, field notes, and associated photographs or documents uploaded through the mobile application;
  6. Expense and reimbursement data, including expense claims, expense categories, amounts, photo receipts, approval statuses, and reimbursement records;
  7. Leave and holiday data, including leave requests, leave balances, holiday calendars, and team availability information;
  8. Device and usage data, including mobile device type and model, operating system version, app version, device identifiers, IP address, battery status, and network connectivity information;
  9. Customer and client visit data, including client names, visit addresses, visit timestamps, purpose of visit, and post-visit notes or outcomes entered by the Field Employee;
  10. Photographs, documents, and media files uploaded by Field Employees in connection with task completion, expense claims, or client visits;
  11. Information contained in communications sent to us via email, chat, or through the Platform, including content, metadata, and associated technical information;
  12. Where the Platform provides referral or “invite” features, we may collect limited personal data of the referred individual, such as name, email address, or phone number. You represent and warrant that you have obtained the necessary consent from such individual prior to sharing their information.

Certain areas of the Platform may be accessed without providing personal data; however, access to specific features and services may require submission of personal data, including Registration Information such as your name, email address, mobile number, and login credentials.

Where personal data is obtained from third-party sources based on your consent or authorization, such data shall be processed strictly in accordance with applicable laws, internal policies, and appropriate safeguards, and only for the purposes of operating, maintaining, and improving the Platform.

Before disclosing any personal data of another individual to us, you must obtain their valid consent for such disclosure and for subsequent processing in accordance with this policy. In the event of any disputes, claims, or liabilities arising from such “on behalf of” submissions, you shall remain solely responsible and liable under applicable data protection laws and regulations.

PROCESSING PERSONAL INFORMATION

The Company and its authorized partners/processors collect and process your personal data for the following purposes (the “Purposes”):

  1. To send you administrative communications, service-related notices, account confirmations, reminders, updates, and other transactional communications relevant to your use of the Platform;
  2. To enable Business Users to onboard, manage, monitor, and administer their field workforce through the Platform’s web dashboard and mobile application;
  3. To collect, record, and process Field Employees’ GPS location data, attendance records, task data, route history, and expense information for the purpose of workforce management, productivity monitoring, payroll processing, and operational reporting;
  4. To process and manage the service requests, and transactions, and to fulfill obligations arising out of any contracts entered into between you and the Company;
  5. To enable Business Users to assign tasks to Field Employees, track task completion, optimize field routes, monitor visit histories, and improve operational efficiency;
  6. To conduct internal operations such as market research, analytics, service improvement, product development, troubleshooting, and to enhance user experience and service quality;
  7. To detect, prevent, investigate, and protect against errors, fraud, unauthorized access, or other illegal or harmful activities, and to ensure the security and integrity of the Product;
  8. To share data with third-party service providers, contractors, payment processors, and technology partners who support the operation of the Product, subject to appropriate confidentiality, data protection, and contractual safeguards;
  9. To enforce the Company’s terms and conditions, policies, and contractual rights;
  10. To comply with applicable legal, regulatory, compliance, and investigative requirements, including responding to lawful requests, court orders, or legal proceedings;
  11. To analyze usage patterns, trends, and user behavior on the Product in order to improve functionality, performance, and security;
  12. To provide you with information about services, features, offers, wellness programs, or events that are similar or related to those you have previously availed or shown interest in, and to send marketing communications (only where you have provided your consent, where required);
  13. To notify you about changes, updates, or modifications to the Product, services, or your user account;
  14. To respond to your queries, requests, feedback, complaints, or support needs;
  15. To facilitate payroll processing, HR administration, compliance reporting, and workforce analytics for Business Users, based on attendance and activity data collected through the Platform.
  16. To enable integration with third-party HRMS, payroll systems, and enterprise resource planning (ERP) platforms as authorized by the Business Users.

CONSENT NOTICE

By accessing or using the Platform, you acknowledge and provide you’re free, specific, informed, unconditional, and unambiguous consent to the collection and processing of your personal data and sensitive personal data for the purposes set out in this policy.

The purposes for which your personal data may be processed include, but are not limited to:

  • providing and facilitating field workforce management services through the Platform;
  • enabling GPS-based attendance tracking, route monitoring, and field productivity management;
  • managing employee profiles, task assignments, expense claims, and leave records;
  • processing payments and transactions;
  • improving, personalizing, and securing the Product and user experience;
  • complying with applicable legal and regulatory obligations; and
  • Responding to your queries, requests, or support needs.

In the case of location data and background location tracking, processing shall be carried out only on the basis of explicit consent provided through the mobile application’s permissions interface. Where required, consent shall be obtained from user including but not limited to consent for GPS tracking, background location access, and data sharing with Business Users.

You have the right to withdraw your consent at any time, by contacting us through the details provided in this policy. Upon such withdrawal, we shall cease processing your personal data unless such processing is required or authorized under applicable law. Please note that withdrawal of consent for location tracking and related permissions may affect your ability to access or use certain features of the Product.

CONSENT TO OVERRIDE DND

By using the Product and its services, you specifically provide consent to the company to send you transaction, service explicit & service implicit communications which are essential to continue the services like sending OTP for log-in, attendance notifications, task alerts, location tracking status updates, and application status communications, irrespective of your Do Not Disturb Registration with TRAI, DoT and/or any other Appropriate Authority. Similarly, you provide your explicit consent for sending across various communications on your registered email as well as phone number through various communication applications like WhatsApp as may be integrated with portal in future.

PRODUCT DISCLAIMER

The Product acts solely as a technology intermediary facilitating field workforce management tools and services between Business Users (companies/admins) and their Field Employees. The Company provides a SaaS platform for employee tracking, attendance, task management, and reporting, and does not act as an employer of, or in any employment relationship with, Field Employees using the Platform. The Business User (employer) is solely responsible for ensuring that its use of the Platform, including the monitoring and tracking of its employees, is in compliance with applicable Indian employment laws, labor regulations, and data protection obligations. The Company shall not be liable for any employment-related decisions, disputes, or actions arising from the Business User’s use of the Platform.

SHARING OF PERSONAL DATA

As a policy, the Company does not disclose your personal data or sensitive personal data except to the extent necessary and in accordance with the purposes set out in this Privacy Policy.

We may share your personal data with our employees, officers, professional advisors (including legal, financial, and financial professionals), and authorized third-party contractors or service providers strictly on a need-to-know basis and subject to appropriate confidentiality and data protection obligations.

We may also disclose your personal data to any member of our corporate group (including subsidiaries, affiliates, and holding companies) as reasonably necessary for the purposes described in this Privacy Policy, and in compliance with applicable data protection laws.

Sharing of Field Employee Data with Business Users

Where a Business User has deployed the Platform to manage their field workforce, the following categories of Field Employee data will be made accessible to the Business User through the Platform’s dashboard and reporting features:

  • Attendance records, punch-in/punch-out timestamps, and GPS-verified attendance data;
  • Real-time and historical GPS location data and route histories;
  • Task assignment and task completion records;
  • Expense claims and reimbursement records;
  • Leave records and availability data;
  • Performance analytics and productivity reports;
  • Customer/client visit records and field activity logs.

Field Employees acknowledge and consent that their employer (Business User) will have access to the above categories of data as part of the Platform’s intended functionality. The Business User, as the employer, is responsible for notifying Field Employees of the nature and extent of monitoring conducted through the Platform and for obtaining any additional consents required under applicable law.

Your personal data may be shared with third-party service providers who process such data on behalf of the Company, strictly for the purposes outlined in this Privacy Policy and subject to contractual confidentiality and security obligations. These may include:

  • Payment processing service providers (including payment gateways and transaction facilitators);
  • Identity verification and KYC service providers;
  • Fraud detection and prevention agencies;
  • Payment processing service providers (including payment gateways and transaction facilitators);
  • Identity verification and KYC service providers;
  • Fraud detection and prevention agencies;
  • Digital marketing, analytics, and content delivery partners;
  • Cloud hosting providers and application/service infrastructure providers;

  • Any other service provider engaged strictly on a need basis to enable delivery of services through the Platform.

The Platform may feature or enable access to third-party products, platforms, or services. If you choose to interact with such third parties, their processing of your personal data shall be governed by their respective privacy policies. The Company does not control and is not responsible for the privacy practices of such third parties.

Notwithstanding the above, the Company reserves the right to disclose your personal data where such disclosure is necessary or appropriate, including:

  1. To comply with applicable laws, regulations, legal processes, or governmental requests;
  2. Where we believe in good faith that such disclosure is necessary to protect our rights, enforce our terms, prevent fraud, or ensure the safety of users or others;
  3. In connection with any ongoing or prospective legal proceedings or investigations;
  4. In connection with a merger, acquisition, restructuring, or sale of assets, in which case you’re personal data may be transferred to the relevant third party, subject to appropriate safeguards. You will be notified of any such change as required by applicable law;
  5. In the event of a business transfer, investment, or restructuring, where your personal data may be shared with advisors, investors, or acquirers and subsequently transferred to the new entity, subject to confidentiality obligations;

We may also use, share, license, or distribute aggregated or anonymized data that does not identify you personally, for purposes including analytics, research, product improvement, and reporting to business partners or other third parties.

SECURITY OF YOUR PERSONAL INFORMATION

  1. We will take reasonable technical and organizational precautions to prevent the loss, misuse, or alteration of your personal information. We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once we receive it.
  2. We use a combination of firewalls, encryption techniques and authentication procedures, among others, to maintain the security of your online session and to protect the accounts and systems from unauthorized access.
  3. All electronic financial transactions entered into through our Platform will be protected by encryption technology.
  4. Location data, attendance records, and other sensitive workforce data are stored in secure cloud infrastructure. Access to such data is governed by strict role-based access control policies.
  5. Our databases are protected from general employee access both physically and logically. We implement data access logging and monitoring to detect unauthorized access attempts.
  6. You acknowledge that no method of transmission over the Internet, or method of electronic storage, is 100% secure, however, therefore, we cannot guarantee its absolute security. If you have any questions about security on our Platform, you can contact us on the email provided in contact us section of this Policy.

DATA TRANSFERS

The Platform is primarily operated for businesses and users located in India. Information that we collect may be stored and processed in India or in other countries where the Company’s cloud infrastructure partners operate. Where personal data is transferred outside India, such transfers shall be conducted in accordance with the provisions of the Digital Personal Data Protection Act, 2023, and any applicable rules framed thereunder, including to countries that have been notified by the Central Government as permissible jurisdictions. You expressly agree to the transfers of personal information described in this Section.

USING YOUR INFORMATION FOR MARKETING PURPOSES

From time to time, we may request additional personal data or sensitive personal data to enable you to access enhanced features or derive additional benefits from the Platform. Such information shall be collected and processed strictly in accordance with this Privacy Policy and applicable law.

The Company may aggregate and anonymize personal data in a manner that does not identify you individually and use or disclose such aggregated data for the following purposes:

  1. To analyze trends, usage patterns, and outcomes for improving the Platform, services, and user experience;
  2. To generate workforce analytics, benchmarking data, and operational insights for Business Users in relation to broader industry benchmarks;
  3. To share anonymized and aggregated data with business partners, research organizations, or third parties for analytics, research, product development, and promotional purposes, provided that such data does not identify any individual user.

We do not sell or share your identifiable personal data with third parties for their independent marketing or promotional purposes without your explicit consent.

We may engage third party service providers to support the operation and functionality of the Platform, including services such as communication delivery (e.g., emails, notifications), data hosting, analytics, and feature enablement. Such third parties shall process personal data only on our behalf and in accordance with our instructions.

All third-party service providers are bound by contractual obligations to ensure appropriate confidentiality, security, and lawful processing of personal data, and are prohibited from using your personal data for any purposes unrelated to the services they provide to us.

RETENTION OF PERSONAL INFORMATION

We need your personal data in order to:

  • Provide our products and services to you.
  • Manage our business for our legitimate interest
  • Comply with legal obligations, if any

You may choose not to share personal data or withdraw consent but doing so may limit the services we are able to provide to you. However, once you choose to withdraw the consent the personal data which has been shared, shall continue to remain with us for as long as the applicable law provides.

We may retain your Personal Data for a period of time consistent with the purpose of collection. We determine the appropriate retention period for Personal Data on the basis of the amount, nature, and sensitivity of your Personal Data, the potential risk of harm from unauthorized use or disclosure, and whether we can achieve the purposes of the processing through other means, as well as the applicable legal requirements (such as applicable statutes of limitation). If there is any information that we are unable, for technical reasons, to delete entirely from our systems post appropriate retention period, we will put in place appropriate measures to prevent any further use of the data

We need your personal data to provide our products and services, manage our business for legitimate interests, and comply with applicable legal obligations, if any. You may choose not to share your personal data or may withdraw your consent at any time; however, doing so may limit the services we are able to provide to you. Notwithstanding such withdrawal, any personal data already shared with us shall continue to be retained for as long as required under applicable law.

RIGHTS OF DATA PRINCIPALS AS PER DPDPA, 2023

As per the Digital Personal Data Protection Act, 2023, individuals (Data Principals) are endowed with specific rights concerning their personal data. Our Company is committed to upholding these rights:

CHANGES TO YOUR PERSONAL INFORMATION

Business Users may update their company information and administrator profile details through the web dashboard. Field Employees may request updates to their personal information through the mobile application or by contacting their employer (Business User) who can make such updates through the admin portal. If you’re personal Information provided when you applied for a Product, changes, you may update it whenever you apply for a new platform. To review and update your personal information to ensure it is accurate while your account is active, please contact us using the details in the Contact Us section

We will retain your information for as long as your account is active or as needed to provide you services or as may be required for internal analysis purpose or as may be required by law, whichever is later. If you wish to cancel your account or request that we no longer use your information to provide you services, contact us at email provided in contact us section of website. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

LOG FILES

As is true of most mobile based product, we gather certain information automatically and store it in log files. This information may include internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data. For the mobile application, we may also collect application log data, crash reports, and device diagnostic information to assist with troubleshooting and platform improvement. We may combine this automatically collected log information with other information we collect about you. We do this to improve services we offer you, to improve marketing, analytics, or platform functionality

TRACKING TECHNOLOGIES / COOKIES

If enabled, we may place cookies on your machine that store small amounts of data on your computer about your visit to any of the pages of this Website. They can identify the pages that are being viewed and this can assist us in tracking which of our features appeal the most to you and what content you may have viewed on past visits. Business Users may also integrate single sign-on (SSO) with their existing enterprise identity management systems, subject to the applicable integration terms.

If you submit personal information to any of those sites, your information is governed by their privacy policies and they will be acting as data controllers of your information. Business Users must provide appropriate notice to their Field Employees regarding the nature and extent of monitoring conducted through the Platform and must obtain any consents required under applicable law.

You are responsible for maintaining the confidentiality of your login id and password. You shall not copy, modify, transmit, distribute / re-distribute, reverse engineer etc., but not limited to, or in any way exploit the Products or any other copyrighted materials and content provided other than for your individual training. Any other purpose is expressly prohibited under these terms. You shall also not permit anyone else to copy, use, modify, transmit, distribute or in any way exploit the Products or any other copyrighted materials, trademark/ registered mark, the designs, innovations, business ideas etc., which together shall be known as IPR and the ownership of the same belongs to the company. Any infringement, theft etc., of the IPR of the company shall result in criminal proceedings against you at your risk, cost and consequences.

You will not allow any third party to attempt to copy, record or reverse engineer any Videos or Documentation supplied by Company or stored on the website or mobile application (or related) websites, outside the application in any manner.
